38 indicted by Upshur County Grand Jury (2024)

BUCKHANNON – An Upshur County Grand Jury returned indictments against 38 individuals Tuesday, for alleged crimes including wanton endangerment involving a firearm, cruelty to animals and drug delivery resulting in death.

Matthew Edward Summerfield-Duke, 27, of Buckhannon, was indicted on two felony counts of wanton endangerment involving a firearm; one misdemeanor count of domestic assault; and one misdemeanor count of being a prohibited person in possession of a firearm.

A criminal complaint states that Summerfield-Duke used a 30-30 caliber lever-action rifle to deliberately fire two rounds into the upstairs ceiling of his Fayette Street home in June.

Bryon Daniel Schooley, 38, of Buckhannon , was indicted on three felony counts of cruelty to animals.

In August, Schooley told Buckhannon Police Department officers he “strangled his pet cat,” according to the criminal complaint.

Schooley allegedly told officers he strangled the cat and then skinned it, because he thought it was sick, the complaint states.

Mindy Corena Stalnaker, 38, of Buckhannon, was indicted on one felony count of drug delivery resulting in death; and one felony count of conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code.

Terry Lee Duke, 37, of Tallmansville was indicted on one felony count of taking the identity of another; one felony count of forgery of a public record; one felony count of uttering a forged public record; and one misdemeanor count of obstructing an officer.

In a separate indictment, Duke was indicted on one felony count of possession of stolen goods; one misdemeanor count of obstructing an officer; and two misdemeanor counts of possession of a controlled substance.

Lucas Wayne Leary, 28, of Philippi, was indicted on one felony count of taking the identity of another; one felony count of forgery of a public record; one felony count of uttering a forged public record; one misdemeanor count of attempted petit larceny; and one misdemeanor count of obstructing an officer.

Mack David Metz, 50, of Buckhannon , was indicted on five felony counts of fraudulent use of an access device.

James William Corbin, 54, of Rivesville, was indicted on one felony count of fleeing with reckless indifference to the safety of others.

Charles Wayne Pringle, Jr., 46, of French Creek, was indicted on one felony count of burglary; two misdemeanor counts of assault; and two misdemeanor counts of harassment.

Kevin Jay Cowger, 48, of Clarksburg, was indicted on two felony counts of entry of a building other than a dwelling; one felony count of attempted entry of a building other than a dwelling; one felony count of attempted grand larceny; one felony count of destruction of property; one felony count of grand larceny; and one misdemeanor count of petit larceny.

Katrina Nicole Sandy, 32, of French Creek, two felony counts of retaliation against a public official.

Randall Gene Bender, Jr., 42, of Buckhannon, was indicted on one felony count of failure to provide notice of a change to required sex offender registration information, second or subsequent offense, lifetime registrant.

Hank William Heckman, 33, of Buckhannon, was indicted on two felony counts of failure to provide notice of a change to required sex offender registration information, lifetime registrant. .

Bonnie Sue Bryant, 44, of Buckhannon, was indicted on two felony counts of aiding and abetting a sex offender in eluding law enforcement.

Nicky Joe Heater, Jr., 33, of Orlando, indicted on one felony count of worker’s compensation fraud; and one felony count of insurance fraud.

Keanan Michael Lee, 25, of Rock Cave, was indicted on three felony counts of fraudulent use of an access device; and one misdemeanor count of petit larceny.

Anthony Todd Gassett, 55, of Buckhannon, was indicted on one felony count of child neglect resulting in bodily injury; and two misdemeanor counts of domestic battery.

Joyce Maxine Nelson, 45, of Horner, was indicted on one felony count of battery on a law enforcement officer, second offense; and one misdemeanor count of breathing or inhaling intoxicating substances.

Steven James Riffle, 32, of Buckhannon, was indicted on one felony count of possession of a controlled substance with the intent to deliver; and one felony count of conspiracy to commit a felony violation of Chapter 60A, Article 4, Section 401 of the WV code.

Seth Warren Morgan, 28, of Buckhannon, was indicted on one felony count of conspiracy to violate Chapter 60A, Article 4, Section 401 of the West Virginia State Code.

Sheldon Kirk Harris, 25, of Buckhannon, was indicted on one felony count of possession of a controlled narcotic substance with the intent to deliver; two felony counts of delivery of a controlled narcotic substance; one felony count of transportation of controlled narcotic substances into state, a felony; and one felony count of conspiracy to violate Chapter 60A, Article 4, Section 401 of the West Virginia State Code.

Johnnie L. Perrine, 45, of French Creek, was indicted on one felony count of failure to provide notice of change to sex offender registration information.

Donald Lynn Wright, 69, of French Creek, was indicted on one felony count of failure to provide notice of change to required sex offender registration information, life registrant.

Douglas Craig Casto, 54, of French Creek, was indicted on one felony count of failure to provide notice of change to required sex offender registration information.

David Charles Blagg, 28, of Tallmansville, was indicted on one felony count of fleeing with reckless indifference to the safety of others; one misdemeanor count of driving while license revoked for DUI; one misdemeanor count of fleeing by means other than the use of a vehicle; one misdemeanor count of obstructing an officer; one misdemeanor count of no registration; one misdemeanor count of no insurance; and one misdemeanor count of operation of a vehicle without certificate of inspection.

David Tyler Raines, 32, of Belington, was indicted on one felony count of being a prohibited person in possession of a firearm; and one felony count of conspiracy.

Joseph Tyler Simmons, 40, of French Creek, was indicted on one felony count of prohibited person in possession of a firearm; and one felony count of conspiracy.

Christopher Don Chidester, 30, of Buckhannon, was indicted on one felony count of fleeing in a vehicle with reckless indifference to the safety of others; one misdemeanor count of fleeing by means other than the use of a vehicle; and one misdemeanor count of no registration.

Samuel Matthew Smith, 37, of French Creek, was indicted on one felony count of driving while license revoked for DUI, third or subsequent offense.

In a separate indictment, Smith was indicted on one felony count of driving while license revoked for DUI, third or subsequent offense; one misdemeanor count of no insurance; one misdemeanor count of no registration; and one misdemeanor count of possession of a controlled substance.

Krystal Lea Winters, 34, of French Creek, was indicted on one felony count of gross child neglect creating substantial risk of serious bodily injury or death.

Robin Denise Arbogast, 50, of Weston, was indicted on two felony counts of distribution and display to a minor of obscene matter.

Nicky Lynn Bailey, 37, of French Creek, was indicted on one felony count of fleeing in a vehicle while under the influence of a controlled substance; one one felony count of fleeing in a vehicle with reckless indifference to the safety of others; one misdemeanor count of driving under the influence of controlled substances; one misdemeanor count of possession of a controlled substance; one misdemeanor count of no insurance; and one misdemeanor count of driving while license suspended.

Bryan David Shaw, 41, of Buckhannon, was indicted on two felony counts of possession of a controlled substance with the intent to deliver; and one felony count of being a prohibited person in possession of a firearm.

Christina Joe Brunina, 44, of Buckhannon, was indicted on one felony count of forgery; and one felony count of uttering.

Donald P. Hull, Jr., 39, of Spartansburg, South Carolina, was indicted on one felony count of being a prohibited person in possession of a firearm; and one misdemeanor count of driving under the influence of controlled substances.

Austin Shane Tawney, 33, of Buckhannon, was indicted on one felony count of transportation of a controlled narcotic substance into state; and one felony count of conspiracy to commit a felony violation of Chapter 60A, Article 4, Section 401 of the WV code.

Lucas John Hyre, 35, of Buckhannon, was indicted on one felony count of transportation of a controlled narcotic substance into state; and one felony count of conspiracy to commit a felony violation of Chapter 60A, Article 4, Section 401 of the WV code.

Michael Aaron Hinchman, 38, of Buckhannon, was indicted on one felony count of attempted burglary; one misdemeanor count of possession of a controlled substance; and one misdemeanor count of destruction of property.

Randall William Osburn, 36, of Buckhannon, was indicted on three felony counts of failure to provide notice of change in required sex offender registration information.

Upshur County Prosecutor Bryan Hinkle’s office stresses that an indictment is merely an accusation. All defendants are presumed innocent unless and until proven guilty.
